Terms and Conditions – Glitchy Monkey

These Terms and Conditions (“Terms”) govern your use of the website https://www.glitchymonkey.com (the “Site”) and your purchase of products from Glitchy Monkey (“we”, “us”, or “our”).

By accessing or using the Site, or by placing an order with us, you agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase products from us.

1. About Us

Glitchy Monkey is a clothing brand offering T‑shirts, hoodies, and related apparel.

We operate out of the United Kingdom and use Printify and its network of print providers to produce and ship our products.

2. Eligibility

By using the Site or placing an order, you confirm that:

  • You are at least 18 years old (or the age of majority in your jurisdiction), or you have permission from a parent or legal guardian; and

  • You have the legal capacity to enter into a binding contract with us.

3. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms.

You must not:

  • Use the Site in any way that violates applicable laws or regulations;

  • Attempt to gain unauthorised access to any part of the Site, our servers, or any connected systems;

  • Upload or transmit any malicious code, viruses, or harmful materials;

  • Use the Site to harass, abuse, or harm others;

  • Use automated tools (such as bots or scrapers) to access the Site for any unauthorised purpose.

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms.

4. Products and Descriptions

We aim to display our products, colours, and designs as accurately as possible. However:

  • Colours may vary slightly due to screen settings and printing variations;

  • As our products are made to order, minor variations in print position, colour, or size may occur between items;

  • Product descriptions, prices, and availability are subject to change at any time without notice.

We reserve the right to discontinue any product at any time.

5. Orders and Contract Formation

  1. Placing an order
    When you place an order on our Site, this is an offer to purchase products from us in accordance with these Terms.

  2. Order acceptance

    • We will send you an email acknowledging receipt of your order. This does not mean your order has been accepted.

    • Acceptance occurs when we send a confirmation email stating that your order has been accepted (or when we dispatch your order), at which point a contract is formed between you and us.

  3. Order refusal or cancellation by us
    We may decline or cancel an order, including but not limited to when:

    • The product is unavailable or out of stock;

    • We cannot authorise your payment;

    • There is an error in the pricing or description of the product;

    • We suspect fraudulent or unauthorised activity.

If we cancel an order after payment has been taken, we will refund the full amount you paid for that order.

6. Prices, Taxes and Payment

  1. Prices

    • All prices are shown in USD unless stated otherwise.

    • We reserve the right to change prices at any time. Changes do not affect orders already accepted.

  2. Taxes and duties

    • Prices may or may not include applicable sales taxes, depending on your location and our store settings. Any applicable taxes will be shown at checkout.

    • You may be responsible for additional customs duties, taxes, or fees imposed by your country’s authorities on international orders. These are not controlled by us.

  3. Payment

    • We accept payment via the methods shown at checkout (e.g. credit/debit cards, PayPal, etc.).

    • Payment must be made in full at the time of order.

    • Payments are processed by third‑party payment providers. We do not store your full payment card details.

7. Shipping and Delivery

  1. Fulfilment via Printify
    We use Printify and their network of print providers to produce and ship our products. As a result:

    • Products are typically made to order;

    • Items in a single order may be fulfilled by different print providers and may arrive in separate packages.

  2. Processing and shipping times

    • Average production time is 5–7 business days.

    • Estimated shipping time for destinations we serve is 7–14 business days after production.

    • Actual delivery times may vary based on location, customs, and carrier performance.

  3. Shipping policy
    Shipping methods, costs, supported countries, and further details are set out in our Shipping Policy, which forms part of these Terms. By placing an order, you agree to the terms of our Shipping Policy.

  4. Risk and title

    • Risk in the products passes to you when they are delivered to the address you provided.

    • Ownership of the products passes to you once we have received full payment for them.

8. Returns, Exchanges and Refunds

Because our products are printed on demand, our returns and refunds are limited.

  1. Change of mind / wrong size

    • We generally do not accept returns or exchanges for change of mind, incorrect size selection, or similar reasons, unless stated otherwise in our returns policy.

  2. Faulty, damaged, or incorrect items
    If an item arrives damaged, defective, or different from what you ordered:

    • You must contact us at info@glitchymonkey.com within 5 Days of delivery.

    • Include your order number, a description of the issue, and clear photos of the product and packaging.

    • We will work with Printify and the relevant print provider to investigate and, where appropriate, arrange a replacement or refund.

  3. Returns/refunds policy
    For full details, please refer to our Returns/Refund Policy, which forms part of these Terms.

  4. Your statutory rights
    Nothing in these Terms affects your statutory rights as a consumer under applicable law (including, where relevant, UK consumer protection laws).

9. User Accounts

You may be able to create an account on our Site.

You are responsible for:

  • Keeping your account details and password confidential;

  • All activities that occur under your account.

You must notify us immediately if you believe your account has been compromised.

We may suspend or terminate accounts that we believe are being used in breach of these Terms or in an abusive or fraudulent manner.

10. Intellectual Property

  1. Our content

    • All content on the Site, including logos, designs, graphics, text, images, and layout, is owned by or licensed to Glitchy Monkey and is protected by copyright, trade mark, and other intellectual property laws.

    • You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site or our designs without our prior written permission, except as permitted by law.

  2. Limited licence

    • We grant you a limited, non‑exclusive, revocable licence to access and use the Site for your personal, non‑commercial use only, in accordance with these Terms.

  3. Trademarks

    • “Glitchy Monkey” and any associated logos or marks are our trademarks or registered trademarks. You may not use them without our prior written consent.

11. User Content

If the Site allows you to submit reviews, comments, images, or other content (“User Content”):

  • You are solely responsible for the User Content you submit.

  • You must not submit anything unlawful, offensive, defamatory, infringing, or otherwise objectionable.

  • By submitting User Content, you grant us a worldwide, non‑exclusive, royalty‑free, perpetual licence to use, reproduce, modify, and display such content in connection with our business (for example, on the Site or in marketing materials), in any media.

We reserve the right, but not the obligation, to remove or edit User Content at our sole discretion.

12. Third‑Party Services and Links

Our Site may include:

  • Links to third‑party websites or services (such as social media platforms);

  • Integrations with third‑party services such as Printify, payment providers, and analytics or advertising tools.

These third parties have their own terms and privacy policies, which you should review. We are not responsible for the content, policies, or practices of third‑party sites or services.

13. Data Protection and Privacy

We collect and process personal data in accordance with our Privacy Policy, which forms part of these Terms.

By using the Site and placing an order, you acknowledge and agree that we may process your personal data as described in our Privacy Policy, including for order fulfilment, customer support, marketing (where permitted), and analytics.

14. Disclaimers

To the maximum extent permitted by law:

  • The Site and all content are provided on an “as is” and “as available” basis.

  • We do not guarantee that the Site will be uninterrupted, secure, or free from errors or viruses.

  • While we aim for accuracy, we do not warrant that product descriptions, images, or other content on the Site are complete, reliable, or error‑free.

Nothing in these Terms is intended to exclude or limit any warranties or rights that cannot be excluded or limited under applicable law (including your statutory rights as a consumer).

15. Limitation of Liability

To the fullest extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Site or purchase of products.

  • Our total aggregate liability to you for any claim arising out of or relating to these Terms, the Site, or any products purchased shall not exceed the total amount you paid to us for the product(s) giving rise to the claim.

Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by our negligence;

  • Fraud or fraudulent misrepresentation;

  • Any other liability that cannot be limited or excluded under applicable law.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales.

If you are a consumer and resident in the UK or another country, you may also benefit from mandatory provisions of local consumer law in your country of residence.

You and we agree that the courts of England and Wales will have non‑exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Site.

We may update these Terms from time to time, for example to reflect changes to our practices, products, or legal requirements.

  • When we make changes, we will update the “Last updated” date at the top of this page.

  • The latest version of the Terms will always be available on the Site.

  • Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the Site and (where applicable) stop purchasing products from us.
